CRISIS ROCKS AGN AGAIN …As Emeka Ike returns to court

Six months after the court threw out the case he instituted against the Actors’ Guild of Nigeria (AGN) Board of Trustees over the election of Segun Arinze as the association’s president, Emeka Ike has returned to the court room.

Emeka Ike’s case was struck out in March, on technical grounds.
He had gone to court to challenge the leadership of Segun Arinze as the AGN president. His case was struck out in March on technical grounds.

Unsatisfied with the judgement, the actor in a dramatic turn, returned to the court on Monday with the matter coming up at the Federal High court, Ikoyi. But unfortunately,the absence of the judge who was said to be indisposed stalled the resumption of hearing of the new application filed in by the actor.

Emeka’s counsel, Malcolm Omirhobo told HVP during the week that they are back in court to continue the case which they instituted against Segun Arinze and the BoT some six months ago, stressing that the case was however adjoined till 26th of October, 2011.

His words; ‘we are back in court. The case came up today(Monday) but unfortunately, the judge was indisposed and so, it was adjoined till 26th of October, for our pending application to be heard.

The new application was a replica of the previous application that was struck out six months ago. The matter was struck out on technical grounds but two weeks after, we filed in a fresh application as the law requires.”he stated.

Continuing, the counsel stressed that “when a matter is struck out in a court of law, it does not mean that the case is dead. You have the right to return to court if you so desire. ”

“We were only asked to go back and put one or two things in place, which we have done. If a matter is dismissed, it means you cannot come back to court again, except when you wish to appeal against the judgement. We have decided to return to court.

On the forthcoming AGN general election which is billed to take place in November, this year, the counsel warned that no election should be conducted while the matter is still in court.

“Whatever election that will be conducted by Segun Arinze will be an exercise in futility. Arinze cannot give what he does not possess. He has no power to transfer, and if at the end of the day, there is an election, those who participated in such election will be wasting both their money and their time. An illegal government cannot transfer power to a legal government.” he declared.

While reacting to the threat, the guild’s Secretary General, Mr Yakabu Abubakar said, the proposed general election of the guild will hold as planned, pending when the court will rule otherwise.

Emeka had gone to court last year to challenge the leadership of Segun Arinze as the AGN president. He is praying that the court should declare an election that brought Segun Arinze into office null and void. The actor also is praying that the court should compel the BoT to appear and explain why they should remain in office.
